So here goes (again I lost the first one in cyber space!) So my dears Im back at the end of my ever loving rope with Midland credit management collection agency...This is to all my cyber pals (and future ones) Your sitting on a proverbial ticking timebomb! Credit cards! Baddd back away from the credit cards! As some of you already know I have been fighting with these yahoos (MCM) for a year and a half. So I get a PC about 2 weeks ago from an alleged attorney representing these nasty people (you all know what happend) I hung up! Yeah well a couple of days later I get a letter from the law offices of Harris and Zide in San Diego California (notice how I wrote that all out so take note please!) its for your own good! I decide to speak to the person (her name is Cynthia) Yeah never piss me off Ill get back to her later on my own time! Or maybe just make her part of the law suit! Hmmm what to do... what to do??? So I talk to her Fax to her re fax to her and she comes back with...Well it looks as though its been paid but I will have to get back to you in 48 hours after I consult with a supervisor. Ok I say...48 hours no call so I stupidly figure they get that I paid right??? Wrong I just got summoned to Civil Court! WHAT?! What the hell universe are you idiots operating in?! Ok so I call up the courts..they say if I dont respond I am liable...Yes I know this but what I am saying is...is there a way that I can prove they are wasting the courts time I have all the proof you need and then some! No Im sorry you have to respond...AND theres a fee too! 400 bucks! HELLO twilight zone! So today I have (yes I did!) Contacted the govenors office the state legislators office the state attorney general the district attorneys office the FTC (yet again) and the BBB on these Yahoos I want them blacklisted and said so! I want legislation controlling collection agencies! I have now got a lawyer... again! I thought what are the odds of ever needing my attorney again? Good thing I didnt erase the phone number! Check your credit reports guys and girls dont ignore them! I am now in Politics! I hate politics! Calgon!!!!! Take me out of this twilight zone!!!!!!!!!!! Argh!!

Yes Gail it was frustrating to say the least and I would have put a freeze on had Midland re-reported a fraudulent claim for medical.They did that twice and changed account numbers so in the event that I didnt see this I would have had no proof that it was fraud. That is why I posted this thread to help others if this ever happens to them.... Wink

Bunnys, This sounds like a nightmare! I'm glad you won the civil case, but it sounds like you went through so much frustration, anxiety, and anger in the process. I have considered putting a freeze on my credit reports, but it's not that easy to lift the freeze, and there are times when you need to do it pretty quickly. For example, when my dad's CG was exerting "undue influence", I had to shift his savings that same day into a new account that I had to open (this could not have been done with the credit freeze as the bank always does a credit check before opening a new account). Instead, I have a service CreditSecure that monitors activity on my credit reports and notifies me of each activity. I spend more time than I should going over my credit reports and correcting erroneous info, like a second mortgage from a house I no longer own and that was paid off over a year ago.

Your situation sounds like an attempt on the part of the collection agency to extort money, since it's clear that no money was owed, and as you say some people will simply pay the credit collection company some money to get them to go away even if they don't owe the money. You were right to fight them. Good work!

Update: As of today after $500 and an Attorney I got the Civil Case dismissed..Credit agency cleared the fraudulent file from Midland after I threatened them with legal action since my lawyer is on speed dial now! I never knew you could threaten the Credit B. Well now ya know! So to all my online buddies out there if you dont owe anything to them in the first place NEVER give these morons anything! DO NOT accept the deals they offer to shut them up it doesnt work (I didnt do this but others have) Check out Rip off .com for companies that might be comin after you there are alot of nightmare stories out there in cyberland! Stick to your guns like I did the nightmares WILL end it just might cost you a little to do it but considering what they come after you for (it was over $2000 they were tryin to get out of me that I already paid for to the original credit card company Providian) By the way Providian credit cards....If you have them, call first to ask for print out statements showing ALL transactions made on the account and payments made (midland placed transactions on our statement record that werent even made by us! Case in point transactions that were made in Los Angeles on a date and time we were living in N California! Yes they are that crooked!) after you receive the statement attach a copy of the cancelled check from your bank...Call back and cancel the credit card and ask for the closing statement printout to be mailed to you. If they do not comply bug them till they give in its your right! The reason for the Providian warning...Providian has and is selling information to collection agencies a few years down the road to make a buck from collection agencies. Yes ALL information on accounts IS SOLD for profit even if they make $100 dollars on it. Can you imagine how much this company willfully steals each year?! Collection Agencies are just as guilty of this tactic. If one cant get a dime out of you they SELL your info to another CAgency.

Heres another warning to all. Since I last posted this I got the credit reporting agencies to delete the fraudulent debts and in the past 2 weeks Midland (after not responding or giving proof to the CRA) have now succeeded in posting another medical claim on the CRA files! There are two ways to deal with this, one is to put a fraud alert on your file (but this doesnt prevent them from posting to your file) the other way is to place a freeze on your file. This prevents any company from checking your credit, posting fraudulent claims. The only thing you cant do is apply for credit while the freeze is on file so you will have to call to have it lifted if you need to apply for credit.

You said a mouthful Casey One of the worst culprits here is Providian...Thats right Providian. They actually are the ones that started this mess. Since it is illegal for collection agencies to just go off credit reports and hound you what really happens is the credit card companies are keeping your information for future underhanded dealings even if you have paid and closed the account (which I did) They then sold our information to a collection agency to make a little more money!
And I guess it didnt help that they were in a Class action lawsuit at the time of the illegal selling of my information! So guys and girls if you have Providian anything Close the account and ask for hard copies of all the ending transactions and report it yourself to the Credit reporting agencies if after 6 months you do not see it on the report. In my experience they might only report to the east coast credit agency rather than all 3. And they will change the name on the report. If it is a visa dont be surprised if they report it as a Mastercard or something else. The Credit reporting agencies take "their" word for it not yours so keep anything you get from anyone to complete a trail from the time it starts to the end. Even the collection letters sent to you. And I have to say I have read that there is a 4 year ruling in New York for debt (companies cant go after you as it is a dead debt) Ive been reading that they are going after people at 5,6,7, years and even 10. So dont throw away paperwork like the old days cause the 7 year rule no longer applies here with these Yahoos.
By the way Casey interesting article Im glad you did this as alot of people dont know about paying credit card tricks to up your scores (paying partial rather than all at the end of a month) But here is a heads up before doing credit counseling do searches on the companies you are dealing with cause guess what?! Midland Credit Management is one of those companies and in dealing with them you are giving all relevant information about yourself (ss# adresses to be reached ect ect) Can you feel the nightmare starting there? Eek You have just handed these yahoos a book on how to get to you and didnt even know it! The reason why I say this This company in particular will lower the amount of your debt in these situations (read complaints against this company on a simple search) then they will come after you a year or 2 after debts are paid and tell YOU this was not authorized by management! Thats right! They have done this alot!

What a nightmare! You are right to warn people about the dangers of letting credit get out of control. I just added a mini-library or articles on credit and debt at Credit and Debt Relief Library
