Well, I have a drug dependent leaching brother who moved in with my mother in her senior citizen apartment. He told the doctor and the apartment management that he was caring for my mother so he was allowed to live with my mother's. For many years, my mother has been the victim stolen money based on my brother stealing. My mother will not prosecute him per the bank. I have Dual Power of Attorney but my mother and my name are on her checking account. Now, I am finding out that he is taking her to the bank twice a month getting her to write "cash" checks in the amount of 60 to $200.00. When I speak to my mother about it she either does not remember going to the bank or she gets angry that I do not want her to give my brother money. My mother beings telling that I am treating my brother badly over sums of money.

Any suggestions?

Ok Denise I just got off the phone with her she says you can go into the bank and speak with the branch manager about this.
You can request either (or both) that no checks coming in to be cashed, written out to "cash" and/or written out to your brother can not be cashed unless your notified or not at all since you are an owner on this account.
Notify APS of this and they will investigate if this is indeed fraud.
This goes under the heading of Fiduciary Abuse aka Elder abuse and will be prosecuted with vigor if proven.
If your mom is diagnosed by her PCP this also goes a long way to proving this charge.
Do you have a POA on your mom?
If so take it into the bank with you so they can have a record of it on file.

Im so sorry I see this alot myself and I am in total agreement with MB call APS on him.
If shes in subsidized housing...Im a little leery of this I dont think they can have family members living with them, care giving or not they can have visitors but unless his name's on the rental/lease agreement I think he should be outta there and if your name is on the bank account you can also report him I think.

What a sad situation, Denise... and unfortunately, all too common. So long as your mom is considered competent, it's her money to do with as she pleases. Short of turning him in to the cops, taking him to court, or calling elder protection to investigate, there's not much you can do.

Because she IS in subsidized housing, I think the Elder Protection folks would be your best ticket... They are required to keep mum about who made the complaint and also to investigate ALL claims, regardless of whether the complaint seems unfounded. The fact that she lives in subsidized housing would actually help in this case, as I am sure there are regulations about who can and cannot live with a qualifying resident and about drug use in government housing.
