This is an article describing a new type of collections company that specializes in collecting from estates. It has some good information in it, and we will all sadly face this sooner or later. It's good to know our rights, and also have the heads up what lying weasels these companies are. (Well, we knew, but it helps to have enough information to know WHEN they are lying and what they are lying about.)

California state law is once an Estate closes thats it no collecting so I kindly ask them if they got a shovel Eek
Im sorry morbid humor at work here but dang it I get a little sick n tired of these jerks (and some of them are!) that cant remember one little detail...Im the daughter! Roll Eyes

Hmmm,veeery interesting. Wink When oldest bro died almost 5 years ago, for a while I was picking up his mail and checking his messages, but other bro was executor. I helped winnow the wheat from the chaff when I could. Frown

Some of the mess that came up would have been funny under any other circumstances. For instance...It seems he rented the DirecTV equipment, they wouldn't let me close the billing simply because he was dead and the TV was gone, no one to watch it anyway. It was their equipment and he still had it so rent was due. Eek

I said they should come and get it, or at least give me an address to ship it back, because it wasn't being used. They stopped billing then and never came to pick it up or give me an address to ship to. Why, they didn't want it back!!! .. The mess was so outdated !!! But they wanted to keep billing until they got called on it.

There was also a collection agency after a hospital bill that bro forgot to file with his insurance (the one with the duck). I called them and told them he was unable to get back to them because he was DEAD. They didn't even ask when he died (it was recent, still in probate). Never heard from them again.

This group is searching probate courts for info. But that is the issue. They come after family hoping that family feels a need to put a loved one to rest with no debt over their graves. Much is truly bogus(like the outdated DTV dish and box).

There is a joke about giving an address for the cemetary to collections agencies. But probate is for the purpose of giving enough time for legitimate debts to be claimed against the estate. In this state, a year. No distributions to heirs can be made before then without the executor being personally responsible. Claims need to be made against the estate. Period. Calls to you can be ignored if you are not the executor.

This is going to be a real biggy.

I'm sure they Mad "hook" Mad many of the "older" generation who didn't believe in credit.

Another way "scam" the elderly!
