Need help for mother living in ALF and is on Medicaid Wairver program. Long story, but her SS income increased from $650/mo to $2073/mo after ex-husband passed-away and was awarded his benefits upon death from divorce. Now, her income exceeds the Medicaid program monthly limit of $1911. She cannot afford a a lawyer, and need to find someone that can give elder law advice on such matters. I tried a "free" legal aid group in Broward County, but they were clueless.

Are you saying she was overpaid, she didn't know it, and now they want the money back?

No, her SS income increased now, and it will exceed the income limit for medicaid. I can't afford $1000s for an elder law attorney, and not sure where to turn to for consultation.

Hi nobody... So I assume this means that because she no longer qualifies for the Medicaid Waiver Program... are they threatening to throw her out of the ALF or something? Seems like they would simply put the money toward her expenses... Have you discussed this with the social worker from the ALF or Ombudsman?

Welcome in N102 First they can not throw her out of there. 2nd I would speak to the Medical SW on staff there and tell them whats going on so they can recommend what to do next they have experience in situations like this and know what to do.
Since she is eligible for his SS benefits did he have anything else like a pension? Military?
Kind of strange though if they were divorced am I understanding that correctly?
I think I would double check and call SS to see if they didnt make a mistake on this, you know?
